The UPR referenced above was considered by the City
Commission at their August
15, 2006 meeting and was deferred to the August 22 meeting, pending
clarification of Planning Commission vote. A more complete history of the
previous UPR for this property was requested by the City Commission.
The City Commission
had specifically asked if the Restrictive Covenants had been filed. They were
filed with the Douglas County Register of Deeds on Dec. 30, 1998.
History of UPR-05-09-94: Adaptive Reuse of 805 Ohio
May, 1994; Application was submitted to the Planning Office.
June 22, 1994; Planning Commission recommended
denial of the UPR request based on concerns with allowing the increased density
in an area zoned for single-family uses.
July 19, 1994; City Commission voted to approve the
UPR, subject to Staff and applicant developing conditions to be reviewed and
approved by the City Commission and the findings of fact.
July 26 1994; City Commission approved the
conditions for the UPR for 805 Ohio
and adopted revised Findings of Fact.
December 1, 1998; City Commission voted to rescind the
UPR due to unmet conditions effective December 20 1998. The multi-family use was not permitted
until certain conditions were met.
February 16, 1999; City Commission
reinstated the UPR and approved revisions to the conditions. Commission
established a schedule for submission of annual progress reports and Staff
inspections of the property.
April 25, 2004; City Commission approved a one-year
extension of milestones which were to be completed by September 1, 2004 thus extending the
UPR to September, 2005.
