Please include the following information requested by the City Commission for item #1 on the City Commission agenda for the August 22nd meeting.

UPR-05-08-06;  USE PERMITTED UPON REVIEW FOR A MAIN LIVING UNIT AND THREE RENTAL UNITS; 805 OHIO STREET

The UPR referenced above was considered by the City Commission at their August 15, 2006 meeting and was deferred to the August 22 meeting, pending clarification of Planning Commission vote. A more complete history of the previous UPR for this property was requested by the City Commission. Planning staff has received a fax from the applicant regarding the application for listing 805 Ohio on the Lawrence Register of Historic Places.

 

Project History.  An application for listing 805 Ohio on the Lawrence Register of Historic Places was received by the Planning Office on March 26, 1999.  The Historic Resources Commission held a public hearing on the application on May 20, 1999.  At that meeting, Commissioner Morley made a motion to table this item until plans are presented for the rear of house.  He said this was a local register property and he didn’t feel comfortable casting a vote without knowledge of what changes would be made.  In addition, he concurred with Commissioner Dean’s comments on the lack of historic background.  Commissioner Smalter seconded the motion. The motion to table L-1-1-1999 until additional information was submitted regarding historical aspects of the nomination and the extent of rear porch modifications  was approved 6-0-0.  The applicant was asked to submit the information to Staff and the item would be scheduled for a future agenda.

 

Project Status, The Lawrence Register of Historic Places nomination has remained in the pending file since May 20, 1999 waiting for additional information from the applicant.  One condition of approval for UPR-05-9-94 was landmark listing: The owner shall, prior to occupancy as a multiple-family structure, submit completed applications for individual listing as a Landmark structure on the Lawrence and State Historic Registers. “Listing” implies the completion of the nomination process.  Complete application includes information requested by the HRC to complete the review.  This milestone was reiterated in the extension requests in February 1999 and April 2004.

 

Staff Recommendation  Staff recommends as a condition of approval for UPR-05-08-06, the applicant provide the requested information for the completion of the review and listing of the property to the Lawrence and Kansas Registers of Historic Places.
