Sale, Possession and Consumption of Alcohol Beverages at South Park for Immanuel Lutheran Church “Oompahfest”

 

 

Staff has recently received a request from Immanuel Lutheran Church to allow alcoholic beverages on the west side of South Park in connection with its annual “Oompahfest” celebration.  Immanuel Lutheran Church has reserved the west side of South Park on September 9, 2006, and is requesting approval to sell, possess, and consume alcoholic beverages in that west area of South Park on September 9th between the hours of 11:00 a.m. and 4:00 p.m. The church has also applied for a temporary permit with both the Alcohol Beverage Control Bureau of the Kansas Department of Revenue and our office in order to sell alcoholic beverages at the event.

 

The possession and consumption of alcoholic beverages on City property is prohibited by City Code. However, section 4-105(E) of the City Code allows the City Commission to exempt, by ordinance, specified City property from the prohibition of alcoholic beverages on public property. Therefore, an ordinance allowing the temporary sale, possession and consumption is required.  I have attached a copy of Ordinance No. 8028 for the Commission’s consideration. This ordinance authorizes the sale, possession and consumption of alcoholic beverages on September 9, 2006 in South Park on the west side during the hours of 11:00 am and 4:00 p.m.
