STAFF PRESENTATION
Ms. Day, Planning Staff, gave
an introduction of the request to rezone
APPLICANT PRESENTATION
CL Maurer, Landplan, for applicant appeared to answer any questions posed by the Planning Commission.
Maurer replied that the applicant is the builder and there is not yet a homeowners association.
PUBLIC HEARING
No member of the public spoke regarding this item.
COMMISSION DISCUSSION
Harris questioned the connection of the peripheral setback reduction and the variance for the setback.
Burress asked if it made a difference whether the PDP states a waiver or variance is requested.
Day stated it does not matter.
Erickson pointed out that concrete is misspelled on the plan.

NO. 12A:
Moved
by Jennings, seconded by Harris, to recommends approval of the .85 acres from
RS-2 [RS7] (Single-Family Residence) District to PRD-1 (Planned Residential
District) and forwarding it to the City Commission with a recommendation for
approval based on the findings of fact found in the body of the staff report
and subject to the following conditions:
1.
Recording of a final plat prior to publication of the rezoning
ordinance;
2.
Approval of a preliminary development plan prior to the publication of
a rezoning ordinance.
3.
Provision of a
note that indicates housing type shall be limited to single-family detached
dwelling units.
Motion passed unanimously, 8-0.

NO. 12B:
Moved by
1.
Provision of a
revised Preliminary Development Plan to include the following changes as noted
by City Staff:
a.
Revision to
General notes Number 6 to be removed as not applicable to this development.
b.
Provision of a
revised Preliminary Development Plan to restrict occupancy of the homes to
comply with the definition of family applicable to conventional single-family
(RS) districts.
c.
Provision of a
revised Preliminary Development Plan to list all waivers associated with the
proposed development.
d.
Provision of a
note that states “Conformance with the general architectural character of the
surrounding area shall be required and building elevations shall be provided
with the submission of the Final Development Plan for approval.”
2.
Execution of an
agreement not to protest the formation of a benefit district for future
intersection improvements for
Waivers (PUD’s): The proposed development includes following requests
to reduce required setbacks as follows:
1.
Reduction of the
required side yard from 10’ to 5’ for Phase III of the development, thus being
applicable to the entire PRD.
2.
Reduction of the
peripheral setback from 35’ to 20’ for

of required open space to 0.
