Z-05-13-06: A request to rezone a tract of
land approximately 1.40 acres, from RS-2 [RS7] (Single-Family Residence) to RS5
(Single-Dwelling Residential). The
property is generally described as being located near

PF-06-14-06: Replat of Homewood Gardens Addition, replat of
lots 1-4, block 9 & lots 4-6, block 10. Submitted by Bartlett & West
Engineers, Inc, for Tenants to Homeowners, Inc, property owner of record.
Items 4A & 4B were discussed simultaneously.
STAFF
PRESENTATION
Ms. Miller, Staff, gave an
introduction, history and overview of the property. The property was donated by
the City to Tenants to Homeowners with the understanding that the lots would be
used for affordable housing. The
rezoning and replatting would provide pedestrian access to the future “Rails to
Trails” park and a walkable neighborhood with many transit opportunities. The Old East Lawrence Neighborhood Association,
Brook Creek Neighborhood Association and The Woods on 19th
Homeowners Association provided letters of support. The rezoning and replatting are in compliance
with Horizon 2020 and the Burroughs Creek Corridor Plan and Staff recommends
approval.
APPLICANT PRESENTATION
Joe Caldwell, Bartlett and West, for Rebecca Buford of
Tenants to Homeowners, applicant, stated they concur with Staff and have no
issues with the conditions for approval.

pedestrian access easement to the linear park by separate instrument.

noted;
b. Note added granting ‘temporary right of entry’ for
City to plant Street Trees.
c. 10’ utility easement along the front of the
property reduced to 7.5’.
d. 10’ Westar easement required along the northern
property line of

Provision of the following fees and recording documentation:

Recording fees
made payable to the Douglas County Register of Deeds;
b.
Provision of a
revised master street tree plan. The notes concerning credit for existing
