ORDINANCE NO. 8027

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS ADOPTING THE UNIFORM PLUMBING CODE, 2003 EDITION, WITH AMENDMENTS; AMENDING CHAPTER 5, ARTICLE 6 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2003 EDITION, AND AMENDMENTS THERETO.

 

 

Section 1.  Chapter 5, Article 6, Section 601 of the Code of the City of Lawrence, Kansas, 2003

Edition, and amendments thereto is hereby amended to read as follows:

 

5‑601                PLUMBING CODE INCORPORATED.

"The Uniform Plumbing Code, 2000 2003 Edition," published by the International Association of Plumbing and Mechanical Officials, 2001 Walnut Drive South, Walnut, California, 91789, 5001 E. Philadelphia Street, Ontario, California, 91761, and all amendments and supplements thereto, are hereby incorporated by reference and made a part hereof as if fully set out herein save and except certain parts, sections or portions thereof specifically referred to and omitted therefrom or as amended or modified herein.  Not less than three copies of said code, marked or stamped in the manner provided by K.S.A. 12‑3010 with all sections or portions thereof intended to be omitted clearly marked and showing portions that are amended and to which shall be attached a copy of amendments, shall be filed with the city clerk, and shall be open to inspection and available to the public at reasonable business hours.  Official copies of such Code shall be supplied at the cost of the City to the officials and agencies in the manner listed and set forth in K.S.A. 12‑3010. Section 2.  Chapter 5, Article 6, Section 603.1 of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto is hereby amended to read as follows:

 

5‑603.1            EXEMPT WORK.

103.1.2.1 is hereby amended to read as follows:

 

103.1.2.1 The stopping of leaks in drains, soil, waste or vent pipes, provided, however, that should any trap, drainpipe, soil, waste, or vent pipe become defective and it becomes necessary to remove and replace the same with new material, the same shall be considered as new work and a permit shall be procured and inspection made as provided in this Code. replacing of traps, faucets or plumbing fixtures in an existing structure.  The relocation of any fixture or addition thereto shall be considered as new work and a permit shall be procured and inspection made as hereinbefore provided.

 

EXCEPTION:  Domestic garbage disposers and electrical dishwashers may be installed by dealers and/or their employees, only if connected to existing plumbing vents or drain lines above the floor, beneath the sink and outside the wall if existing plumbing is in accordance with applicable standards.  Expressly, persons installing domestic garbage disposers and electrical dishwashers shall not install, change, alter or improve any electrical or plumbing appurtenance or device used by this appliance. 

 

Section 3.  Chapter 5, Article 6, Section 603.3 of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto is hereby amended to read as follows:

 

5‑603.3            103.3.6 is hereby enacted to read as follows:

 

103.3.6 Permits to do or cause to be done any work regulated by this Code may be issued only to a person holding a valid unexpired, unrevoked and unsuspended plumbing contractor or master gas fitter's certificate of qualification or registration as required by Section 5‑602.1 of this Article, except when and as otherwise hereinafter provided in this Section.

 

103.3.7 is hereby enacted to read as follows:

 

Permits required by this Code may be issued to an owner to do any work regulated by this Code in a single family dwelling used exclusively for living purposes, including the usual accessory buildings and quarters in connection with such dwelling and accessory buildings and quarters, and that the same are occupied by the owner. The owner shall personally purchase all materials and shall personally perform all labor in connection therewith.

 

103.3.8 is hereby enacted to read as follows:

 

A letter shall accompany the permit application stating that the owner is able to do the work, to pass all inspections, and will live in the dwelling for a minimum of one year from the date of the final inspection.

 

EXCEPTION:  Permits required by this Code may be issued to Lawn Irrigation Contractors holding a certificate as a certified Cross-Connection Control Technician, provided the work to be done begins at the main valve of a lawn irrigation system, and is for the purpose of retrofitting an existing lawn irrigation system, which was installed prior to August 1, 1992, to bring the system into compliance with state and local law.  CPVC, PE or PVC water pipe approved for potable water manufactured and installed to recognized standards may be used for retrofits. 

 

Section 4.  Chapter 5, Article 6, Section 603.4 of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto is hereby amended to read as follows:

 

5‑603.4            FEES.

Section 103.4.1(Fees) Shall be amended to read as follows:

 

103.4.1  Permit Fees.   Fees shall be assessed in accordance with the provisions of this section and as set forth in the fee schedule in Table 1-1.  The fees are to be determined and adopted by this jurisdiction.  All permits are subject to the schedule of fees as listed in the Uniform Building Code adopted by the City.  Applicants shall pay for each permit at the time of making an application. 

 

Section 5.  Chapter 5, Article 6, Section 603.5 of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto is hereby amended to read as follows:

 

5‑603.5            ADVANCE NOTICE.

Section 103.5.4.1 (Advance Notice) shall be amended to read as follows:

 

103.5.4.1.  Advance Notice.  It shall be the duty of the person doing the work authorized by the permit to notify the Authority Having Jurisdiction orally or in writing that said work is ready for inspection. Such notification shall be given not less than twenty-four (24) hours before the work is to be inspected.

 

Section 6.  Chapter 5, Article 6, Section 605 of the Code of the City of Lawrence, Kansas, 2003

Edition, and amendments thereto is hereby amended to read as follows:

 

5‑605                PLUMBING FIXTURES.

Section 406.5 is hereby enacted to read as follows:

 

406.5  In no case shall tubs be installed head‑to‑head.

 

Section 7.  Chapter 5, Article 6, Section 606 of the Code of the City of Lawrence, Kansas, 2003

Edition, and amendments thereto is hereby repealed:

 

5‑606              WATER HEATERS AND VENTS.

Section 509.0 (Prohibited locations) shall be amended by the addition of the following exception:

 

EXCEPTION:  An existing water heater located in a bathroom may remain or be replaced by a heater equipped with an approved safety pilot and thermostat and connected to an approved vent outlet pipe in any such bathroom which has at least 400 cubic feet of air content with at least one window in one outside wall. 

 

Section 8.  Chapter 5, Article 6, Section 607 of the Code of the City of Lawrence, Kansas, 2006

Edition, and amendments thereto is hereby amended to read as follows:

 

5-607                WATER TREATMENT UNITS.

Section 603.4.14.1 is hereby enacted to read as follows:

 

603.4.14.1 Permits Required. It shall be unlawful for any person to install, or replace or cause be installed, or replaced any water treatment units that require a wastewater discharge without first obtaining a permit from the Administrative Authority to do so.

 

Section 9.  Chapter 5, Article 6, Section 607.1 of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto is hereby amended to read as follows:

 

5‑607.1            WATER DISTRIBUTION.  

Section 604.1 (Materials) shall be amended to read as follows:

 

604.1 Water distribution pipe, building supply water pipe, and fittings shall be of brass, copper, cast iron, CPVC, galvanized malleable iron, galvanized wrought iron, galvanized steel, PEX, or other approved materials.  Asbestos-cement, PE, PVC, PEX-AL-PEX, or PE-AL-PE water pipe manufactured to recognized standards may be used for cold water building supply distribution systems outside a building.  PEX-AL-PEX water pipe, tubing, and fittings manufactured to recognized standards may be used for hot-and cold-water distribution systems within a building.  PEX-AL-PEX water pipe, tubing, and fittings manufactured to recognize standards may be used for hot-and cold-water distributions systems within a building.  PE-AL-PE water pipe and fittings may be used for cold-water distribution systems within a building.  All materials used in the water supply system, except valves and similar devices, shall be of a like material, except where otherwise approved by the Authority Having Jurisdiction. Water pipe and fitting shall be of brass, copper, cast iron, galvanized malleable iron, galvanized wrought iron, galvanized steel, or other approved materials.  PEX-AL-PEX water pipe manufactured to recognized standards may be used for cold water distribution systems outside a building.  PEX-AL-PEX water pipe, tubing, and fittings manufactured to recognized standards may be used for hot and cold water distribution systems within a building.  CPVC, PE or PVC water pipe approved for potable water, manufactured and installed to recognized standards may be used for the purpose of retrofitting an existing lawn irrigation system, which was installed prior to August 1, 1992.  All materials used in the water supply system, except valves and similar devices shall be of like material except where otherwise approved by the administrative authority. 

 

Section 10.  Chapter 5, Article 6, Section 608 of the Code of the City of Lawrence, Kansas, 2003

Edition, and amendments thereto is hereby repealed:

 

5-608               DRAINAGE SYSTEMS.

Section 701.1.2 (Materials) shall be amended to read as follows:

 

Section 701.1.2  ABS and Cellular core PVC plastic pipe is not allowed in slab or underground.  ABS and PVC DWV piping installations shall be limited to structures not exceeding three floors above grade.  For the purpose of this subsection, the first floor of a building shall be that floor that has fifty (50) percent or more of the exterior wall surface area level with or above finished grade.  One additional level that is the first level and is not designed for human habitation and used only for vehicle parking, storage, or similar use shall be permitted.  (Ord. 6421, Ord. 7390, Ord. 7661, Ord. 7863) 

 

Section 11.  Chapter 5, Article 6, Section 608.1 of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto is hereby amended to read as follows:

 

5‑608.1             DRAINAGE SYSTEMS.

 

TABLE 7-5 (Maximum Unit Loading and Maximum Length of Drainage and Vent Piping) shall be amended to read as follows:

 

                               1. Excluding trap arm.

                                   2. Except sinks, urinals and dishwashers.

                                   3. Except six-unit traps or water closets.

4. Only four (4) water closets or six-unit traps allowed on any vertical pipe or stack, and not to exceed three (3) water closets or six-unit traps on any horizontal branch or drain.

5. Based on one-fourth (1/4) inch per foot (20.9 mm/m) slope. For one-eighth (1/8) inch per foot (10.4 mm/m) slope, multiply horizontal fixture units by a factor of 0.8.

 

Note: The diameter of an individual vent shall not be less than one and one-fourth (1-1/4) inches (31.8 mm) nor less than one-half (1/2) the diameter of the drain to which it is connected. Fixture unit load values for drainage and vent piping shall be computed from Tables 7-3 and 7-4. Not to exceed one-third (1/3) of the total permitted length of any vent may be installed in a horizontal position. When vents are increased one (1) pipe size for their entire length, the maximum length limitations specified in this table do not apply. (Ord. 7661)

 

Section 12.  Chapter 5, Article 6, Section 5-608.2 of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto is hereby amended to read as follows:

 

5‑608.2             DRAINAGE SYSTEMS.

Section 710.1 (Drainage of fixtures located below the next upstream manhole or below the main sewer level.) shall be amended to read as follows:

 

Drainage piping serving fixtures, the flood level rims of which are located below the elevation of the curb or property line, at the point where the building sewer crosses under the curb or property line and above the crown level of the main sewer, shall drain by gravity into the main sewer and shall be protected from back flow of sewage by installing an approved type back water valve, and each such backwater valve shall be installed only in that branch or section of the drainage system which receives the discharge from fixtures located below the elevation of the curb or property line. 

 

                        Section 712.1 shall be amended to read as follows:

 

712.1  Media.  The piping of the plumbing, drainage, and venting systems shall be tested with water or air except that plastic pipe shall not be tested with air. The Authority Having Jurisdiction may require the removal of any cleanouts, etc., to ascertain whether the pressure has reached all parts of the system. After the plumbing fixtures have been set and their traps filled with water, they shall be submitted to a final test.

                       

Section 13.  Chapter 5, Article 6, Section 5-608.3 of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto is hereby amended to read as follows:

 

5‑608.3             BUILDING SEWERS.

 

Section 717.0 shall be amended to read as follows:

 

717.0  Size of Building Sewers.  The minimum size of any building sewer shall be determined on the basis of the total number of fixture units drained by such sewer, in accordance with Table 7-8.; however no building sewer shall be smaller than the building drain less than four (4) inches in diameter. 

 

Section 14.  Chapter 5, Article 6, Section 5-608.4 of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto is hereby amended to read as follows:

 

5‑608.4             BUILDING SEWERS.

 

Section 719.7 is hereby enacted to read as follows:

 

719.7  In all cases an approved cleanout using approved type cleanout fittings acceptable to the Authority Having Jurisdiction shall be provided outside of all buildings.  All cleanouts shall be extended to grade. (Ord. 7661)

 

Section 15.  Chapter 5, Article 6, Section 609 of the Code of the City of Lawrence, Kansas, 2003

Edition, and amendments thereto is hereby amended to read as follows:

 

 

5‑609                VENTS AND VENTING.

                        Section 902.3 is hereby enacted to read as follows:

 

902.3  A vent is not required for a floor drain unless the floor drain is located 20 feet or more from a vented waste line or is located four feet or more above a ventilated waste line.

 

Section 16.  Chapter 5, Article 6, Section 610 of the Code of the City of Lawrence, Kansas, 2003

Edition, and amendments thereto is hereby amended to read as follows:

 

 

5-610                MATERIAL FOR GAS PIPING.

Section 1210.1 (Materials) shall be amended to read as follows:

Section 1210.1 All pipe used for the installation, extension, alteration, or repair of any gas piping shall be standard weight wrought iron or steel (galvanized or  black)  or corrugated stainless steel tubing (CSST). Approved PE pipe may be used in exterior buried piping systems.

 

Section 1209.5.2.3 shall be amended to read as follows:

 

1209.5.2.3 Copper and brass pipe shall not be used if the gas contains more than an average of 0.3 grains of hydrogen sulfide per 100 scf of gas (0.7/100L).

            Threaded copper, brass, or aluminum alloy pipe shall not be used with gases corrosive to such material.

 

1209.5.2.3  Copper pipe and tubing may be used for exterior installations, if the gas does not contain more than an average of 0.3 grains of hydrogen sulfide per 100 scf of gas (0.7 mg/100 L). Copper tubing shall comply with standard Type K or L of ASTM B 88, specification for Seamless Copper Water Tube, or ASTM B 280, specification for Seamless Copper Tube for Air-Conditioning and Refrigeration Field Service. Threaded copper or aluminum alloy pipe shall not be used with gases corrosive to such material.

 

Section 1209.5.3.2 shall be amended to read as follows:

 

Section 1209.5.3.2 Copper and brass tubing shall not be used if the gas contains more than an average of 0.3 g of hydrogen sulfide per 100 scf of gas (0.7 mg/100L).  Copper tubing shall comply with standard Type K or L of ASTM B 88, Specification for Seamless Copper Water Tube, or ASTM 280, Specification for Seamless Copper Tube for Air-Conditioning and Refrigeration Field Service.

 

1209.5.3.2  Copper pipe and tubing may be used for exterior installations, if the gas does not contain more than an average of 0.3 grains of hydrogen sulfide per 100 scf of gas (0.7 mg/100 L). Copper tubing shall comply with standard Type K or L of ASTM B 88, specification for Seamless Copper Water Tube, or ASTM B 280, specification for Seamless Copper Tube for Air-Conditioning and Refrigeration Field Service. Threaded copper or aluminum alloy pipe shall not be used with gases corrosive to such material.

 

Section 17.  Chapter 5, Article 6, Section 610.1 of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto is hereby amended to read as follows:

 

5‑610.1             FUEL GAS PIPING.

Section 1212.0 (Appliance Connectors) shall be amended by the deletion of subsection 1212.0(5) and the addition of Subsections (1212.0)(9) and (1212.0)(10):

 

                        Section 1212(5) DELETED.

 

Section 1212.0(10). Gas appliance connectors used in restaurants and commercial food preparation establishments must be approved stainless steel or protective coated stainless steel. (Ord. 7661)

 

Section 1212.1 shall be amended to read as follows:

 

1212.1.  Connecting Gas Equipment.  Gas utilization equipment shall be connected to the building piping in compliance with 1212.4 and 1212.5 by one of the following:

 

                        (1)  Rigid metallic pipe and fittings.

                        (2)  Semirigid metallic tubing and metallic fittings.

(3)  Listed flexible gas connectors in compliance with ANSI Z21.24, Standard for Connectors for Gas Appliances.  The connector shall be used in accordance with the terms of their listing that are completely in the same room as the equipment.

(4)  CCST where installed in accordance with the manufacturer’s instructions.

(5)  Listed non-metallic gas hose connectors in accordance with 12.12.2.

(6)  Gas-fired food service (commercial cooking) equipment listed for use with casters or otherwise subject to movement for cleaning, and other large and heavy gas utilization equipment that can be moved, shall be connected in accordance with the connector manufacturer’s installation instructions using a listed appliance connector complying with ANSI A21.69, Standard for Connectors for Movable Gas Appliances.

(7)  In 1212.1(2), and (3), and (5), the connector or tubing shall be installed so as to be protected against physical and thermal damage.  Aluminum alloy tubing an connectors shall be coated to protect against external corrosion where they are in contact with masonry, plaster, or insulation or are subject to repeated wettings by such liquids as water (except rain water), detergents, or sewage.

(8)  Gas appliance connectors used in restaurants and commercial food preparation establishments must be approved stainless steel or protective coated stainless steel. 

 

Section 18.  Chapter 5, Article 6, Section 610.2 of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto is hereby enacted to read as follows:

 

5-610.2             Section 1214.4.2 shall be amended to read as follows:

 

1214.4.2 The test pressure to be used shall be no less than 1-1/2 times the proposed maximum working pressure, but not less than 3 psi (20 kPa), irrespective of design pressure.  Test pressure inspection shall include an air, CO2 or nitrogen pressure test, at which time the gas piping shall stand a pressure of not less than ten (10) pounds per square inch (68.9 kPa) gauge pressure, or at the discretion of the Administrative Authority, the piping and valves may be tested at a pressure of at least six (6) inches (152 mm) of mercury, measured with a manometer or slope gauge. Test pressures shall be held for a length of time satisfactory to the Administrative Authority, but in no case for less than fifteen (15) minutes, with no perceptible drop in pressure. For welded piping, and for piping carrying gas at pressures in excess of fourteen (14) inches (356 mm) water column pressure, the test pressure shall not be less than sixty (60) pounds per square inch (413.4 kPa) and shall be continued for a length of time satisfactory to the Administrative Authority, but in no case for less than thirty (30) minutes. These tests shall be made using air, CO2, or nitrogen pressure only and shall be made in the presence of the Administrative Authority. All necessary apparatus for conducting tests shall be furnished by the permit holder. Test gauges used in conducting tests shall comply with Section 319.0, Test Gauges.

 

Section 19.  Chapter 5, Article 6, Section 611 of the Code of the City of Lawrence, Kansas, 2003

Edition, and amendments thereto is hereby amended to read as follows:

 

5‑611                PENALTY.

Any person violating any of the provisions of this Article or the "Uniform Plumbing Code, 2000 2003 Edition," as incorporated by Section 5‑601 of this Article, shall be subject to a fine not to exceed five hundred dollars ($500) or to imprisonment not to exceed three (3) months or both at the discretion of the court.  Each day that any such violation continues shall constitute a separate offense.  (Ord. 7661)

  

Section 20.      Chapter 5, Article 6, Sections 5-601, 5-603.1, 5-603.3, 5-603.4, 5-603.5, 5-605, 5-607, 5-607.1, 5-608.1, 5-608.2, 5-608.3, 5-608.4, 5-609, 5-610, 5-610.1, and 5-611 of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto are hereby repealed, it being the intent of this Ordinance to substitute the provisions in place thereof.  Chapter 5, Article 6, Sections 5-606 and 5-608 of the Code of the City of Lawrence, Kansas 2003 Edition and amendments thereto are hereby repealed.  Chapter 5, Article 6, Section 5-610.2 is hereby enacted.

 

Section 21.      The ordinance shall be in full force and take effect upon its publication as provided for by law.
