STAFF RECOMMENDATION: Staff recommends approval of the Final Plat of Yankee Tank View Addition 2nd Plat and forwarding it to the City Commission with a recommendation for acceptance of easements and rights-of-way subject to the following conditions:
1. Execution of an agreement not to protest the formation of a benefit district for future street or sidewalk improvements for Clinton Parkway and Olympic Drive; 2. Provision of a revised Master Street Tree Plan with the following changes: a. List the required number of trees required for the future Olympic Drive extension. b. Correct name of plat on MSTP to ‘Yankee Tank View Addition 2nd Plat” c. Correct the botanical names of the species as follows: Norway Maple—Acer platanoides ‘Summershade’; Sugar Maple—“Acer saccharum ‘Legacy’; and Pacific Sunset Maple is Acer truncatem x platanoides. 3. Provision of the following revisions to the final plat: a. Standard road right-of-way on the plat for the extension of Olympic Drive to the City park to the north. b. Show unnecessary easements as vacated or remove from the plan. The utility easements on the rear and west property line of the northern portion of the property previously platted as Lot 2A, The Landing are no longer necessary and should be shown as vacated or deleted from the plan. c. Utility easement provided along the rear and side perimeter of the property. d. Minimum area and elevation of existing buildings must be shown. e. Section, township and range must be corrected on the plat to SW ¼, Sec. 4-T13S-R19E 4. Submission of public improvement plans prior to the recording of the Final Plat with the Register of Deeds Office. 5. Provision of the following fees and recording documentation: a. Recording fees made payable to the Douglas County Register of Deeds; b. Provision of a revised master street tree plan. The species list on the master street tree plan must be completed and the legal description changed to: ‘Yankee Tank View Addition 2nd Plat’. |

STAFF REVIEW
The subject property is located at 5200 Clinton Parkway. This property is located on the north side of Clinton Parkway, east of Lake Alvamar. The property is currently developed with a private sports facility, First Serve Tennis, and the property is being replatted to provide additional land for the expansion of the indoor tennis facility and the construction of outdoor tennis courts.
Streets and Access
The property lies to the north of Clinton Parkway. Olympic Drive extends northward from Clinton Parkway and a frontage road, Clinton Parkway (frontage road) branches off to the east approximately 200’ north of Clinton Parkway. The sports facility takes access from Clinton Parkway (frontage road). City and the dance studio property lines are being reconfigured to provide the additional land for the expansion. This plat includes the transfer of property from the future City park in Lot 1 to First Serve Tennis. Part of this transfer agreement was the requirement that the standard road right-of-way for Olympic Drive would be provided on the final plat. This will allow for the future extension of Olympic Drive to provide access to the City park from the south. This future right-of-way for the extension of Olympic Drive must be shown on the final plat. This future extension should be included in the computations for street trees required on the Master Street Tree Plan.
Utilities and Infrastructure
Lot 1 has a 100’ KPL overhead transmission easement bordered by 10’ utility easements on both sides. The plan shows a 30’ wide area along the west property line that will be dedicated for a public street when a similar area to the east is dedicated for a public street. It will be necessary for the applicant to provide the standard road right-of-way at this time for the extension of the public street, Olympic Drive.
There are several easements which were dedicated on the earlier plat but will not be used for utilities, as a result of the reconfiguration of lots. The easement along the west property line shall remain. All easements being vacated must be shown on the plat and any relocation of existing utilities will be at developer’s expense.
The Final Plat should be revised to show the existing utility easements, the vacationing of unneeded easements and dedication of additional easements as required by code. Easements are required where necessary to serve the subdivision and must be located on the side and rear of the property per section 21-609 (10’ along the side of the property and 15’ along the rear). These easements are typically shared across lot lines so that an easement would fall equally on each half of the abutting properties. Staff recommends that only the easements necessary for serving the subdivision be shown on the revised Final Plat as a condition of approval. The easements bordering the portion of Lot 2A that was combined with Lot 2 in this replat are proposed to be vacated by the final plat.
Water and sanitary sewer lines are located to the front of the property, along Clinton Parkway.
Summary
The Final Plat for Yankee Tank View 2nd Addition is in substantial compliance with Zoning Ordinance and Subdivision Regulation requirements.
