TUPR-05-15-06:  A Temporary Use Permitted upon Review request for a promotional display of boats for sale at First State Bank located at 3901 W. 6th Street. Submitted by David Hooper Jr., Manager of First State Bank & Trust, property owner of record.

 

GENERAL INFORMATION

Current Zoning and Land Use:        

RO-2 (Residence-Office) District); existing bank.

C-5 (Limited Commercial District) to the north, west and east, existing commercial uses.

 

 

PCD-2 (Planned Commercial District) to the north and east developing commercial properties

 

 

RO-2 (Residence-Office) District and RS-2 (Single-Family Residence) District to the south, existing residential development.

 

 

RS-2 (Single-Family Residence) District to the west, existing single-family residence.

 

                               

STAFF REVIEW

The subject property is located on the southwest corner of W. 6th Street and Monterey Way. The property is developed with a bank and drive-through facility. The proposed event will take place on Friday and Saturday, May 19th and May 20th. The boats will be located within the parking area to the east and south of the bank and will utilize twelve existing parking stalls. No boats shall be located across any access aisle or in the grassed areas surrounding the site.

 

Per Section 20-1454.4 (a) (8) does not permit administrative approval of properties that are not commercially or industrially zoned. The subject property is zoned RO-2 (Residence-Office) District which creates the conflict noted in subsection (a) (8). In staff’s opinion, the property zoned RO and developed with a non-residential use is suitable for a special event such as vehicle/boat sales on a limited basis. City Commission approval is required because the RO district is not a commercial or industrial district. 

 

Similar boat sales events were approved in April of 2004 and 2005 by the City Commission and were conducted without any negative consequences. The duration of this year’s display will be the same as the previous events. The applicant indicated that they needed a few more spaces for the boat display and 3 additional parking spaces are included in this TUPR request. These additional parking spaces are adjacent to the building and are not located across any access aisles.  The approved site plan for this property [SP-06-38-00] shows that 13 parking spaces were required and 25 were provided. There are 12 excess parking spaces available for this event.

 

Per Section 20-1454.5 of the Zoning Ordinance, the request is classified as a Temporary Use, which does not meet the criteria for administrative approval. In staff’s opinion, all conditions outlined in 20-1454.5 have been addressed.   

 

An approved site plan (SP-6-38-00) is on file in the Planning Office for this subject property. The approved site plan required a minimum of 13 off-street parking spaces and shows a total of 26 spaces provided. The proposed TUPR will not utilize the required spaces for the banking use.  The proposal includes blocking off a display/sales area (approximately 130’ x 25’ + the nine parking spaces located on the north side of the building and 3 parking spaces to the east of the building).  Internal circulation is preserved between the driveway on W. 6th Street and the driveway on Monterey Way and parking spaces on the east and west ends of the property will be available to bank customers, employees and potential customers of the temporary sale.  The display area will be setback the required 50’ from W. 6th Street as indicated on the site plan.

 

The applicant has been informed that applications for a temporary sign permit and a Transient Merchant License must be submitted to the Neighborhood Resources Department and City Clerk’s Office respectively. 

 

Recommendation:   Planning Staff recommends approval of the Temporary Use Permit for a boat display and sales event for Friday and Saturday, May 19th and 20th, 2006.  Sale hours will be from 9AM to 7PM on Friday and from 9AM to 3PM on Saturday. 

 

  1. Signs displayed in conjunction with this use shall comply with City sign regulations and shall not be located on public right of way.  Signs for this activity can only be displayed during hours of operation;

 

  1. Obtain temporary sign permit from Neighborhood Resources Office;

 

  1. Obtain a Transient Merchant’s License from the City Clerk’s Office; and

 

  1. Boat display to be confined to the area along the north side of the building [approximately 130’ x 25’ access aisle and nine parking spaces] and 3 parking spaces on the east side of the building as outlined on the attached plan.
