                                                ORDINANCE NO. 7998

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, ANNEXING PROPERTY PURSUANT TO K.S.A. 12-520 ET SEQ.

 

Whereas,  Pursuant to Lease No. DACW41-1-96-38, the City of Lawrence has certain said property under lease from the U.S. Army Corps of Engineers adjacent to the spillway of the Clinton Lake Reservoir as described in Exhibit “I” of said lease; and

 

Whereas, said area has come to be known as “Sesquicentennial Point” and the City of Lawrence desires to annex said area into the corporate limits of the City of Lawrence.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION I.  The governing body finds that the tract of property described in Section II of this ordinance, hereby incorporated by reference as if fully described, adjoins the boundaries of the City of Lawrence, Kansas.  The governing body further finds that the owners of the tract of property described in Section II have submitted a petition consenting to the annexation of the tract of property into the City of Lawrence, Kansas.  The property is generally located south of the South Lawrence Trafficway (SLT) – Kansas Highway 10, and east of Douglas County Route 458.  The Lawrence-Douglas County Planning Commission recommended annexation of said property on April 17, 2006.  The City Commission voted to approve the annexation on May 2nd, 2006.

 

SECTION II.  The following described tract of property is hereby annexed into the City of Lawrence, Kansas pursuant to K.S.A. 12-520 et seq., to-wit:

 

ALL THAT PART OF THE NORTHWEST QUARTER AND THE WEST HALF OF THE NORTHEAST QUARTER OF SECTION 8, TOWNSHIP 13 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN, DOUGLAS COUNTY, KANSAS, LYING SOUTH OF THE SOUTHERLY RIGHT-OF-WAY OF THE EXISTING SPILLWAY, EAST OF THE EASTERLY RIGHT-OF-WAY OF THE SOUTH LAWRENCE TRAFFICWAY-KANSAS HIGHWAY 10 AND EAST OF THE EASTERLY RIGHT-OF-WAY OF DOUGLAS COUNTY ROUTE 458 ALL IN DOUGLAS COUNTY, KANSAS.  THE ABOVE AREA CONTAINS 97.0 ACRES, MORE OR LESS.

 

SECTION III.   This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
