April 20, 2006

The Board of Commissioners of the City of Lawrence met in special session at 11:05 a.m., in the Planning Department conference room at City Hall with Mayor Amyx presiding and members Highberger (via telephone), Hack (via telephone), Rundle (via telephone), and Schauner (via telephone) participating.

Mayor Amyx called the meeting to order at which time it was moved by Schauner, seconded by Highberger, to recess into executive session for one hour for the purpose of consultation with attorneys for the City for matters privileged under the attorney-client relationship.  Motion carried unanimously. 

The Commission returned to special session at 11:35 a.m. at which time it was moved by Schauner, seconded by Hack to recess the special session until 2:30 p.m.  Motion carried unanimously.  The purpose of the 2:30 p.m. meeting is to consider a motion to recess into executive session to discuss attorney-client matters with attorneys for the City.

At 2:30 p.m., April 20, 2006, Mayor Amyx called the special session of the City Commission back to order.  Mayor Amyx and Commissioner Highberger appeared in person. Vice Mayor Hack and Commissioners Rundle and Schauner appeared by telephone.  At 2:35 p.m. it was moved by Schauner, seconded by Hack to recess into executive session for 30 minutes for the purpose of consultation with attorneys for the City for matters privileged under the attorney-client relationship.  Motion carried unanimously. 

The Commission returned to special session at approximately 3:05 p.m.  It was then moved by Rundle, seconded by Hack, to adjourn the April 20, 2006 special session at 3:05 p.m. Motion carried unanimously. 

April 21, 2006

The Board of Commissioners of the City of Lawrence met in special session at 9:30 a.m., in the City Manager’s conference room at City Hall with Mayor Amyx presiding and Vice Mayor Hack and Commissioner Highberger present.  Commissioners Rundle and Schauner appeared by telephone.

Mayor Amyx called the meeting to order at which time it was moved by Hack, seconded by Schauner, to recess into executive session for 30 minutes for the purpose of consultation with attorneys for the City for matters privileged under the attorney-client relationship.  Motion carried unanimously. 

The Commission returned to special session at 9:40 a.m. at which time R. Scott Beeler, Lathrop & Gage, and counsel for the City of Lawrence, presented information on an Agreement to Hold Lawsuits in Abeyance entered into between the City of Lawrence, 6WAK Land Investments, LLC, and Wal-Mart Real Estate Business Trust. 

It was moved by Hack, seconded by Rundle to authorize the Mayor to execute the Agreement to Hold Lawsuits in Abeyance.  Motion carried unanimously.   

It was then moved by Rundle, seconded by Highberger, to adjourn the special session at 9:45.  Motion carried unanimously.
