RE:	Pachmama’s Sidewalk Dining License

Ken Baker LLC, d/b/a Pachamama’s, 800-804 New Hampshire Streets, recently applied for a sidewalk dining license.  The related site plan (SP-04-31-05) is also included as part of this process.  The applicant has met all necessary requirements to obtain a sidewalk dining license (Applicant’s first Drinking Establishment License was approved on February 14, 2006 and therefore the 70% food sales requirement had not been established, but the applicant anticipates 70% food sales as indicated on the Statement of Gross Receipts which is signed by the applicant).  In addition, the applicant requested that its patrons be allowed to possess and consume alcoholic beverages in the outdoor seating area.  As such, enclosed is Ordinance 7995 which, after its effective date, would allow possession and consumption of alcoholic beverages on this portion of city right of way. 

Staff recommends approval of the sidewalk dining license for Ken Baker LLC d/b/a Pachamama’s and adoption of the related Ordinance 7995.
