TUPR-04-07-06:  A Temporary Use Permitted Upon Review request for a motorcycle show at Slow Ride Roadhouse, 1350 N 3rd Street, on June 10, 2006 from 11 AM to 3 PM. Submitted by Lori Combs of Combs Custom Cycle with permission of property owner.

 

GENERAL INFORMATION

       Current Zoning and Land Use              C-5 (Limited Commercial) District; Licensed premises: Bar and Grill

 

       Surrounding Zoning and Land Use        C-5 (Limited Commercial) District to the east and south; vacant land with graveled surface to the east;  Mobile home sales lot to the south.

 

                                                            M-2 (General Industrial) District to the north and west with small portion RS-2 (Single-family Residence) District; Antique dealer to the north, storage to the west.

 

      

STAFF REVIEW

The subject property is located on the east side of N 3rd Street north of I-70. The property is surrounded by commercially zoned property to the south and east and industrially zoned property to the north and west. A small portion of the property to the west is zoned for Single-family Residence, but is part of the storage facility. The property to the east and south is zoned for Limited Commercial, but is currently undeveloped. Further to the south is a mobile home sales lot. This is the first TUPR request for this property this year.

 

Section 20-1454.4(a)(3) of the City Code permits administrative approval of requests if the property has been site planned with parking in excess of the number required in the zoning ordinance to support the principal use(s) on the property. This request can not be administratively approved because the property meets but does not exceed the parking requirements set forth in the site plan. Per Section 20-1454.5 of the Zoning Ordinance, the request is classified as a Temporary Use which is subject to City Commission approval.

 

The proposed event will take place on June 10th from 11:00 AM to 3:00 PM. The motorcycle display will be located on the paved surface to the west of the building and will not utilize any parking spaces. A 10’ x 20’ tent for t-shirt sales will be located in 2 parking spaces to the north of the building as shown on the accompanying graphic. Per Section 20-1454.6(a)(2) of the City Code, “In no event shall structures or display areas be located any closer than 25 feet to public right-of-ways adjacent to the property.”  The proposed display and tent locations meet this requirement. 

 

The site plan for Slow Ride Roadhouse [SP-09-60-01] was approved by the City Commission on February 26, 2002 and is on file in the Planning Office.  The event is planned for non-peak business hours and there is adequate parking for the anticipated increase. The event is not anticipated to increase accident potential or cause overcrowding of the parking area.

 

The tent must be flame retardant, a fire extinguisher must be provided and “No Smoking” signs must be posted. If the tent has walls, rather than just a canopy, 2 exits with exit signs and emergency lighting must be provided.

 

Additionally, any signs displayed in conjunction with the event shall comply with the City sign regulations and shall not be located on public right-of-way. A temporary sign permit must be obtained from Neighborhood Resources if temporary signage is planned.

 

Recommendation:  Planning Staff recommends approval of the Temporary Use Permit for a motorcycle show at Slow Ride Roadhouse, 1350 N 3rd Street on June 10th 2006 from 11 AM to 3 PM subject to the following conditions:

 

  1. Temporary sign permit must be obtained from Neighborhood Resources Office, if temporary signs are used;

 

  1. If signs are displayed in conjunction with this use they shall comply with City sign regulations and shall not be located on public right of way.  Signs for this activity can only be displayed during hours of operation;

 

  1. Display area or tent may not be within 25’ of public right-of-way.

 

  1. Tent must be certified flame retardant.

 

  1. A 2A1OBC portable fire extinguisher must be provided.

 

  1. “No Smoking” signs must be posted and enforced.

 

  1. Two exits must be provided as well as exit signs and emergency lighting if tents have walls (are not just canopies).
