                                                ORDINANCE NO. 7986

AN ORDINANCE ADOPTING THE OFFICIAL ZONING DISTRICT MAP, PURSUANT TO CHAPTER 20, ARTICLE 1, SECTION 108 OF THE DEVELOPMENT CODE OF THE CITY OF LAWRENCE AS ADOPTED BY ORDINANCE 7985, AS HEREINAFTER SET FORTH, AND REPEALING THE EXISTING ZONING DISTRICT MAP AS INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003 EDITION,” AND AMENDMENTS THERETO.

WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on February 22, 2006, recommended that the “Zoning Map, November 11, 2005 edition” be adopted and incorporated by reference, into the Development Code of the City of Lawrence, November 11, 2005 Edition, pursuant to K.S.A. 12-753 and Chapter 20, Section 108 of the as the “Development Code of the City of Lawrence, November 11, 2005 Edition”; and

WHEREAS, The “Development Code of the City of Lawrence, November 11, 2005 Edition” is a comprehensive revision of the City’s existing zoning regulations and, except as specifically stated therein, has application to all property within the corporate limits of the City of Lawrence, Kansas; and

          WHEREAS, pursuant to the provisions of K.S.A. Chapter 12, Article 7, and further pursuant to K.S.A. 12-753, K.S.A. 12-756, K.S.A. 12-3009, and the Home Rule Authority of the City as granted by Article 12, § 5 of the Constitution of Kansas, the City of Lawrence is authorized to adopt by ordinance and by incorporation by reference, a zoning district map; and

WHEREAS, after due and lawful notice the recommendation of the Lawrence-Douglas County Metropolitan Planning Commission that the “Development Code, November 11, 2005 Edition” be adopted, came before the governing body of the City of Lawrence, Douglas County, Kansas, and after due consideration and deliberation that recommendation on the adoption of the “Zoning Map, November 11, 2005 edition” was approved by the governing body of the City of Lawrence, Kansas.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

SECTION I.  The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.

SECTION II.  That the Zoning District Map, November 11, 2005 edition, is hereby adopted and incorporated by reference into the “Development Code of the City of Lawrence, November 11, 2005 Edition,” as if fully set forth herein, pursuant to K.S.A. 12-753 and Chapter 20, Article 1, Section 108, of “Development Code, November 11, 2005 Edition” as adopted by Ordinance 7985.

SECTION III.  That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003 edition,” of the existing zoning code is hereby repealed as of July 1, 2006, and shall be replaced by the Zoning District Map adopted hereby.

SECTION IV.  This ordinance, after its passage and publication as provided by law, shall be in full force and effect on and after July 1, 2006.
