ITEM NO. 11:           ADOPT NEW ZONING MAP, NOVEMBER 11, 2005 EDITION

           

Z-10-49-04:  Pursuant to the provisions of K.S.A. Chapter 12, Article 7 consider making a recommendation on the adoption of a new “Zoning Map, November 11, 2005 Edition” pursuant to the provisions of the proposed “Development Code, November 11, 2005 Edition,” enacting a new Chapter 20 of the Code of the City of Lawrence, Kansas establishing comprehensive zoning regulations and other land use regulations.  The proposed “Zoning Map, November 11, 2005 Edition” includes zoning designations for all property located within the corporate limits of the City of Lawrence, Kansas.  The proposed “Zoning Map, November 11, 2005 Edition” is incorporated by reference as if fully set forth in this notice. Copies of the proposed “Zoning Map, November 11, 2005 Edition” are available for review at the Office of the Lawrence-Douglas County Planning Department, City Hall, 6 E. 6th Street, Lawrence, Kansas.  The proposed “Zoning Map, November 11, 2005 Edition” is also available at www.lawrenceplanning.org.   TA-10-05-04 and Z-10-49-04 are companion and related items for public hearing at the February 22, 2006 meeting. (These items were referred back to the Planning Commission by the City Commission at their meeting on February 1, 2005.)

 

Commissioner Krebs moved to extend the meeting until 11:00 p.m.

 

STAFF PRESENTATION

Ms. Stogsdill said the large map represented all of the automatic conversions that were represented in the table in 20-110(e).  In addition, there were 11 x 17 maps for all of the special purpose districts which were the GPI, OS, U, H, UR, and the existing PUD designations for the PRD, PCD, and PID’s.  The existing PUD overlay districts for the older PUD’s were Alvamar, Deerfield, Four Seasons, Heatherwood, Hills West, Holiday Hills No. 7, Holiday Hills No. 10, Meadowbrook, and Parkmar.

 

There was also a separate map for the properties that were currently zoned CP (Commercial Parking).  There was no conversion for those properties and were recommended to be rezoned specifically to the designations for the properties that they were adjacent and related to. One area was rezoned to PCD-2 Westgate; several areas to the CS (Commercial Strip) district; to the RM-24 district; and to the RMO district.

 

There was also a series of neighborhood maps which was the result of staff work in the fall of 2004 to specifically look at the older neighborhoods that had a number of lots that did not currently conform to the 7,000 square foot minimum requirement in RS-2.  If they automatically convert to RS-7, they would become non-conforming lots.  She said they had specifically identified areas in Barker, Breezedale, Brookcreek, Centennial, East Lawrence, North Lawrence, Old West Lawrence, Oread, Pinckney, and Sunset Hills, and University Place Neighborhoods that would be rezoned to RS-5.  She said they tried to look at contiguous areas that were at least 4 blocks in size.  The RS-5 district actually had a minimum lot width requirement of 40 feet rather than 50 feet because some of the substandard lots in Brookcreek were 40 feet by 130 feet or 135 feet so they were different from the 50 x 117 that were in the original townsite, but they still were substandard.  The map that staff provided reflected the action that the City Commission took last year in response to comments about some of the properties originally proposed in Oread.  She said Oread actually did have some larger blocks of property so there were some reductions and those reductions were listed in the staff report.

 

There was also the new map for the RMG district and outlined where the existing fraternity/sorority parcels were located that were currently zoned RD. 

 

The Chair pointed out that there was one change where they had a table that referenced PCD for Payless Cashways which had, in the mean time, changed to Crown Chevrolet.  She said they would certainly need to go through those maps and identify if they had some other glitches and that would be something that staff could provide the Planning Commission at mid-month as well.

 

Commissioner Haase asked if it would be appropriate to recommend adoption of those maps with the effective date until July 1, 2006.

 

Ms. Stogsdill said yes.

 

PUBLIC COMMENT

Jane Eldridge said tonight the Planning Commission was thinking about adopting the November 11, 2005, map and there would be a hearing on any changes that had occurred since then.

 

Commissioner Riordan said any substantive changes that the Planning Commission would make to that map, they would have a hearing.

 

Ms. Stogsdill said staff had been keeping track of any rezonings that have happened since November of 2004 so that those rezonings would automatically convert.  Anything that was zoned between now and July 1st and was published, would revert according to the conversion table.

 

Ms. Eldridge said the map was not stagnant, and would constantly be changing.  She asked if it would be available other than on the website.

 

Ms. Stogsdill said they had a layer on the GIS System.  Staff could look on the computer to see what the proposed zoning would be, based on that change.  She said she was specifically thinking about the zonings that were automatic conversions.

 

COMMISSION ACTION

Motioned by Eichhorn, seconded by Ermeling, to adopt the new zoning maps, November 11th 2005 Edition, for adoption on July 1, 2006, pending recommendations outlined in the staff report.  Motion carried unanimously.
