Public Hearing – Vacation of Right-Of-Way  

 

At their meeting on October 11, 2005 the City Commission held a public hearing on the petition of Kevin and Christy Kennedy, 1601 Kentucky Street, and Tom Hoffman and Lee Blackledge, 1538 Tennessee Street, requesting the vacation of the south 20 ft. of right-of-way on 16th Street between Kentucky and Tennessee.  The applicants would like to relocate the sidewalk closer to the street.  The sidewalk is brick and would be reconstructed.  The right-of-way of 16th Street is 100 ft.

 

SBC does have a cable within the existing right-of-way but does not object to the vacation if an easement is retained.  A sanitary sewer main also runs north/south along the rear of the properties.

 

The Historic Resources Commission review had not been received by the public hearing date.  The City Commission directed staff and the applicants to obtain the Historic Resources Commission’s review of this request.  Pending HRC approval, the vacation could be brought back to the City Commission on the consent agenda.  Attached is the HRC review and approval.

 

Action Requested:  Approve Order of Vacation pending approval of final construction documents by the Historic Resources Commission Administrator, and retain an easement for utilities.
