Shelter “Loitering” Issue

 

 

At the City Commission meeting on March 7, 2006, the Commission approved the Lawrence Community Shelter UPR and directed staff to draft language on the “loitering” issue for patrons on the applicant’s property.  Below are two options for the Commission to consider.  Staff was unsure whether the no loitering concern was directed as a requirement or the reasonable efforts of the applicant.  The applicant has indicated a preference for the later.

 

Option 1)   Requirement language

The applicant shall require all patrons or visitors to refrain from standing, sitting, or otherwise having a physical presence on the outside of the premises of the applicant’s front and side yards, unless the patron or visitor: 1)  is on public right-of-way and the sidewalk, 2) making an entrance or exit (ingress or egress) from the building to the public right-of-way and the sidewalk, or 3) in the designated patio area as specified on the plan.

 

Option 2)   Reasonable efforts 

 

The applicant shall make all reasonable efforts to have all patrons or visitors to refrain from standing, sitting, or otherwise having a physical presence on the outside of the premises of the applicant’s front and side yards, unless the patron or visitor: 1)  is on public right-of-way and the sidewalk, 2) making an entrance or exit (ingress or egress) from the building to the public right-of-way and the sidewalk, or 3) in the designated patio area as specified on the plan.

 

 

The applicant has further indicated a desire to expand the outside patio area to accommodate additional usage under either option.
