1. Reason for This Request?
We propose to rezone a portion of the Green Tree Subdivision to allow for a mix of housing types in the immediate area. There are numerous single family lots currently available in this subdivision, as well as the surrounding area. By providing attached single family dwellings along Drum Drive, the developer can offer a variety of housing types and allow more entry level priced structures.
2. What Is the Suitability of Subject Property for the Uses to Which it Has Been Restricted? Due to the rising prices of single family structures in the area we believe it is important to provide a more affordable solution for potential home owners. We have re-platted a portion of this subdivision in order to spread out the cost of the land to more homes. The proposed rezoning would help spread out the development costs of the property and therefore allow potential for owner-occupied attached structures at a reasonable price while still conforming to Horizon 2020.
3. To What Extent Will Removal of Restrictions Detrimentally Affect Nearby Property?
The area involved abuts a multi-family to the west, a City Park to the south and open green space to the east and a large gas easement to the north. No detrimental affects on the neighborhood are anticipated since the added density is adjacent to a higher density, has a back to back relationship
with the single family area and the street configuration allows traffic to exit to streets designed for additional traffic.
4. What Is the Relative Gain to the Public Health, Safety, and Welfare by the Destruction of the Value of the Petitioner's Property as Compared to the Hardship Imposed upon the Individual Landowners? The area will be improved by providing owner-occupied entry-level attached housing in this area.
5. How Does Your Request Conform with the Comprehensive Plan, Horizon 2020?
This proposal conforms with land use recommendations found in Horizon 2020 as it relates to low-density development. Horizon 2020 General Locational & Relational Information per Land Use states that Low Density Residential is the predominant existing land use within the city and that new areas for low-density residential land use are generally located in the southern and western portions of Lawrence and within the Urban Growth Area. Green Tree Subdivision is located near an elementary school and a park which are both highly desired features in the Planning Unit Concept map Figure 11. The overall density of the Green Tree Subdivision is being increased from 3.145 u/ac to 4.081 Lilac, which is still considered low density residential as defined by Horizon 2020.
