BEFORE THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS IN THE MATTER OF THE VACATION OF A UTILITY EASEMENT IN LOT 1, SOUTHWEST SCHOOL ADDITION, IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS.                                                                                        

 

ORDER OF VACATION

 

NOW on this 14TH day of February, 2006, the above entitled matter comes for hearing before the Governing Body of the City of Lawrence, Kansas.

 

THEREUPON, the Governing Body examines the matter, hears comments on the petition and being duly advised in the premises finds as follows, to-wit:

 

1.  The Governing Body has jurisdiction on the subject matter pursuant to K.S.A. 12-502 et seq. as amended.

 

2.  That notice of hearing of said petition and the affidavit of publication thereof are examined and found to have been duly made in strict conformity with the laws of the State of Kansas.

 

3.  That no private rights will be injured or endangered by such vacation.

 

4.  That no objection to said petition has been filed with the City Clerk at the time of or prior to the hearing.

 

5.  That the City Clerk shall certify a copy of this Order to the Register of Deeds of Douglas County, Kansas, for recording as provided by K.S.A. 12-505, as amended.

 

IT IS THEREFORE, BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS, CONSIDERED AND ORDERED that the following described utility easement recorded in Plat Book P15, Page 597 with the Douglas County Register of Deeds, described as follows:

 

      COMMENCING AT THE SOUTHEAST CORNER OF LOT ONE, SOUTHWEST SCHOOL ADDITION, LOCATED IN THE NORTHEAST QUARTER OF SECTION 9, TOWNSHIP 13 SOUTH, RANGE 19 EAST OF THE 6TH P.M., CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS; THENCE SOUTH 88°56’05” WEST, ALONG THE SOUTH LINE OF SAID LOT ONE, A DISTANCE OF 526.76 FEET; THENCE NORTH 00°48’20” WEST, A DISTANCE OF 581.13 FEET; THENCE NORTH 55°09’17” WEST, A DISTANCE OF 120.15 FEET TO THE PONT OF BEGINNING; THENCE NORTH 00°00’00” EAST, A DISTANCE OF 198.59 FEET; THENCE NORTH 35°00’00” EAST, A DISTANCE OF 374.50 FEET; THENCE SOUTH 28°04’22” EAST, A DISTANCE OF 22.43 FEET; THENCE SOUTH 35°00’00” WEST, A DISTANCE OF 358.04 FEET; THENCE SOUTH 00°00’00” EAST, A DISTANCE OF 181.84 FEET; THENCE SOUTH 62°25’22” WEST, A DISTANCE OF 22.56 FEET TO THE POINT OF BEGINNING.
