Re:   Request for Modifications to Water Purchase Agreement

        RWD No. 5, Douglas County

 

Dear Mr. Wildgen:

 

On September 1, 2005 Rural Water District No. 5 sent a written request to you regarding changes to the existing water purchase agreement between the City and District.  A copy of the request letter is attached.  We have been told that there has been no action pending the final adoption of subdivision regulations by the County.

 

In the meantime, we have read of the possible annexation of land along the south edge of the city within the Urban Growth Area and the RWD No. 5 territory.  While the District has no direct interest in the City’s annexation plans, please note that the District has the exclusive right to be the provider of potable water within its territory regardless of its annexation.  We understand that this situation potentially presents challenges for both of us, but challenges that we are confident can be successfully met if we work cooperatively.

 

We understand that the City and County may have differing opinions regarding regulations.  This is a complex issue that may take some time to resolve.  However, this is an issue that does not involve the rural water district.  We have one single purpose; to provide water to landowners that request service within our incorporated boundary.  For this reason we respectfully request that the commission respond to our letter regarding the water purchase agreement.   It is critical to the future of the District that decisions regarding its future water supply be made soon.  Your prompt response will be appreciated.
