ORDINANCE NO. 7940
AN ORDINANCE PROVIDING FOR THE REZONING OF 3.880 ACRES FROM PRD-2 (PLANNED RESIDENTIAL DEVELOPMENT) DISTRICT TO M-1 (RESEARCH INDUSTRIAL) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.
WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on September 28, 2005, recommended that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from PRD-2 (Planned Residential Development) District to M-1 (Research Industrial) District:
WHEREAS, the zoning recommendation came before the governing body of the City of Lawrence, Kansas on October 18, 2005, and after due consideration and deliberation the recommended zoning change was authorized.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
SECTION I. The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.
SECTION II. That the zoning district classification for the following described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:
THE WEST 137.69 FEET OF LOT 3 AND LOT 4, BLOCK THREE, UNIVERSITY CORPORATE AND RESEARCH PARK NO. 2 (AMENDED); LOT 5, BLOCK THREE, OREAD WEST NO. 10; AND THE EAST ONE-HALF OF RESEARCH PARK DRIVE RIGHT-OF-WAY ADJACENT TO THE ABOVE TRACTS; ALL OF WHICH IS DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHWEST CORNER OF SAID LOT 5, THENCE NORTH 89°51’03” EAST, ALONG THE NORTH LINE OF SAID LOT 5, 276.36 FEET TO THE NORTHEAST CORNER OF SAID LOT 5, SAID POINT ALSO BEING THE NORTHWEST CORNER OF SAID LOT 4; THENCE SOUTH 89°57’50” EAST, ALONG THE NORTH LINE OF SAID LOT 4, 137.69 FEET; THENCE SOUTH 00°08’56” EAST, 582.22 FEET TO THE SOUTH LINE OF SAID LOT 3; THENCE NORTH 89°57’50” WEST, ALONG SAID SOUTH LINE, 137.69 FEET TO THE SOUTHWEST CORNER OF SAID LOT 3; THENCE NORTH 00°08’56” WEST, ALONG THE WEST LINE OF SAID LOT 3, 300.00 FEET TO THE NORTHWEST CORNER OF SAID LOT 3, SAID POINT ALSO BEING THE SOUTHEAST CORNER OF SAID LOT 5; THENCE SOUTH 89°51’03” WEST, ALONG THE SOUTH LINE OF SAID LOT 5 AND ITS EXTENSION, 315.00 FEET TO THE CENTERLINE OF RESEARCH PARK DRIVE; THENCE NORTH 00°08’57” WEST, ALONG SAID CENTERLINE 240.48 FEET; THENCE ALONG SAID CENTERLINE ON A 600.00 FOOT RADIUS CURVE TO THE LEFT WITH A 39.16 FOOT CHORD BEARING NORTH 02°01’08” WEST, AN ARC DISTANCE OF 39.16 FEET; THENCE NORTH 86°06’40” EAST, 40.00 FEET TO THE POINT OF BEGINNING. CONTAINS 3.880 ACRES, MORE OR LESS.
be and the same is hereby changed from that of PRD-2 (Planned Residential Development) District to M-1 (Research Industrial) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto.
SECTION III. That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.
SECTION IV. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
