ORDINANCE NO. 7939

 

AN ORDINANCE PROVIDING FOR THE REZONING OF 4.950 ACRES FROM PRD-2 (PLANNED RESIDENTIAL DEVELOPMENT) DISTRICT TO PID-1 (PLANNED INDUSTRIAL DEVELOPMENT) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.

 

WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on September 28, 2005, recommended that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from PRD-2 (Planned Residential Development) District to PID-1 (Planned Industrial Development) District, provided that the following restrictions of use shall apply:

 

1)  Uses of the property described in Section II of this ordinance shall be restricted to the following use groups:  Use Group 1 – Agriculture – Animal Husbandry; Use Group 2 – Agriculture – Field Crops; Use Group 7 – Community Facilities and Utilities; Use Group 8 – Temporary Uses; Use Group 9 – Professional Offices, except veterinarian offices; Use Group 10 – Off-street Parking; and Use Group 18 – Research and Testing.  In addition, the described property shall be limited to not more than 15 percent of the total land area being devoted to financial institutions, law offices, accounting offices, medical offices, and architectural offices.

 

WHEREAS, the zoning recommendation came before the governing body of the City of Lawrence, Kansas on October 18, 2005, and after due consideration and deliberation the recommended zoning change was authorized.

 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION I.  The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.

 

SECTION II.  That the zoning district classification for the following described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:

                                                 

A PORTION OF LOT 1, OREAD WEST NO. 11, AND THE ADJACENT STREET RIGHT-OF-WAY FOR RESEARCH PARK DRIVE, ALL OF WHICH IS DESCRIBED AS FOLLOWS:

 

BEGINNING AT A POINT ON THE NORTH LINE, 280.10 FEET WEST OF THE NORTHEAST CORNER OF SAID LOT 1; THENCE NORTH 89°57’50” WEST, ALONG SAID NORTH LINE, 129.90 FEET; THENCE NORTH 00°08’56” WEST, ALONG SAID NORTH LINE, 300.00 FEET; THENCE SOUTH 89°51’03” WEST, ALONG SAID NORTH LINE AND ITS WESTERN EXTENSION, 315.00 FEET TO THE CENTER LINE OF RESEARCH PARK DRIVE; THENCE SOUTH 00°08’57” EAST,  ALONG SAID CENTER LINE, 182.75 FEET; THENCE ALONG SAID CENTER LINE ON A 502.15 FOOT RADIUS CURVE TO THE RIGHT WITH A 260.79 FOOT CHORD BEARING SOUTH 14°54’05” WEST, AN ARC DISTANCE OF 263.81 FEET; THENCE SOUTH 29°57’12” WEST, ALONG SAID CENTERLINE, 224.36 FEET; THENCE SOUTH 60°02’48” EAST, 40.00 FEET TO THE NORTHWEST CORNER OF LOT 9, OREAD WEST NO. 6; THENCE SOUTH 89°57’32” EAST, ALONG THE NORTH LINE OF SAID LOT 9, 211.94 FEET TO THE NORTHEAST CORNER THEREOF; THENCE NORTH 00°02’28” EAST, 13.21 FEET; THENCE NORTH 89°59’12” EAST, 23.21 FEET; THENCE NORTH 43°13’09” EAST, 308.51 FEET; THENCE ON A 40.00 FOOT RADIUS CURVE TO THE RIGHT WITH A 47.05 FOOT CHORD BEARING NORTH 79°14’46” EAST, AN ARC DISTANCE OF 50.30 FEET; THENCE NORTH 43°13’09” EAST, 141.63 FEET TO THE POINT OF BEGINNING.  CONTAINS 4.950 ACRES, MORE OR LESS.

 

be and the same is hereby changed from that of PRD-2 (Planned Residential Development) District to PID-1 (Planned Industrial Development) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto, provided that the following restrictions of use shall apply:

SECTION III.  That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.

 

SECTION IV.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
