ITEM NO. 10C:         REPLAT FOR LAWRENCE PUMP STATION #3; 720 GRANT STREET (LAP)

 

PF-10-41-05: Final Plat for Lawrence Pump Station #3, a Replat of Lot 1, Block 4 and part of vacated Perry Street of Smith’s Subdivision, and part of Lot 14 in Simpson’s Central Subdivision, 7th Addition in North Lawrence. The property is generally described as being located at 720 Grant Street. Submitted by Bartlett and West Engineers, Inc. for City of Lawrence, property owner of record. 

 

STAFF RECOMMENDATION: Approval of the Final Plat for Lawrence Pump Station #3 and forwarding it to the City Commission for acceptance of easements and rights-of-way, subject to the following conditions:

1.      Provision of the following fees and recording documentation:

a)     A current copy of a paid property tax receipt.

b)     Recording fees made payable to the Douglas County Register of Deeds.

c)      A completed Master Street Tree Plan in accordance with Section 21-708a.3.

2.      A Temporary Utility Agreement.

3.      Change of plat label “Stanton Street” to “Grant Street”, as Grant Street continues south of the property.

 

Applicant’s Reason for Request:

To formalize the combination of Lot 1 Block 4 Smith’s Subdivision, the south half of vacated Perry Street north of Lot 1 Block 4, and the south part of Lot 14 Simpson’s Central Subdivision.

 

KEY POINTS

·         The legal description for the subject property includes portions of platted lots.

·         A UPR for Lawrence Pump Station #3 and a rezoning of the eastern portion of the lot from the M-3 (Intensive Industrial) District to the M-2 (General Industrial) District are also being considered on the 12/12/05 Planning Commission agenda.

GENERAL INFORMATION

Current Zoning and Land Use:

M-2 (General Industrial) District and M-3 (Intensive Industrial) District [Note: M-2 District zoning pending for the M-3 portion of the site]; undeveloped property.

Surrounding Zoning and Land Use:

M-2 (General Industrial) and M-3 (Intensive Industrial) Districts to the north and south; single-family homes and light industrial uses.

 

M-2 (General Industrial) District to the west; single-family homes and undeveloped property.

 

M-3 and RM-D District to the east; multi-family homes.

STAFF REVIEW

The applicant is requesting final plat approval of Lawrence Pump Station #3, which is a single industrial lot. The site is located northwest of Grant Street.

 

The subject property was originally platted as part of Smith’s and Simpson’s Central Subdivisions. Both plats were filed in the early 1870s. The south half of vacated Perry Street to the north of the Smith’s Subdivision lot is also included with the property.  

 

Street Rights-of-Way

No new rights-of-way are being dedicated with this plat, as Grant Street includes 60 feet of right-of-way. Local streets within the Lawrence city limits should include a minimum 60 feet of right-of-way.

 

Water/Sanitary Sewer Services

Existing water mains are located within the Grant Street right-of-way in front of the subject property. Sanitary sewer mains run north-south through the property and east-west along Grant Street.

 

Conformance

The replat meets the minimum lot size (5,000 square feet), width (50 feet), and depth (100 feet) for the M-2 (General Industrial) District. The new lot will comprise a width of approximately 84 feet at the front property line, width of approximately 82 feet at the rear property line, depth of 92 feet on its eastern side, depth of 157.52 feet on its western side, and lot area of 9,761 square feet.

 

Regarding setback requirements for the M-2 (General Industrial) District, an existing ferrous chloride tank is located within the eastern side yard setback of 20 feet. Prior to placing the UPR application on a City Commission meeting agenda, a variance from the Board of Zoning Appeals is required for the encroachment of this structure. An additional variance is required for the new structure, which encroaches into the front yard setback of 25 feet.

 

Summary

In accordance with Section 21-302.2, the proposed lot has been pinned. The replat conforms with the Zoning Ordinance and Subdivision Regulations.
