Meeting called to order at 6:35 p.m.
Chaney stated that on page 3, paragraph 2. Instead of “making changes”, change to “discuss making possible changes”. Wyatt stated that on page 4, paragraph 1 to add “included” before Mechanical.
Chaney made a motion to approve the minutes as corrected. Seconded by Wyatt, pass 5-0.
Discuss review of 2006 Uniform Mechanical Code when available
Staff requested that if the Mechanical board is planning to wait for the 2006 UMC to avoid incurring gaps in the exhaust and ventilation portions that the 2003 UMC and 2003 IBC has, that a vote reflecting that decision can be presented to the City Commission.
Chaney suggested the Mechanical Board send a letter to the City Commission explaining the reasons for delaying the adoption of the 2006 UMC.
Staff assured the board that the memo from Victor to the City Commission would explain the reason for the delay, but could draft a letter as suggested.
Chaney stated that he would like to explain the board’s perspective. Chaney continued that the board had requested that the Building Board wait until the 2006 UMC was available, but that is not in this board’s control. Chaney stated that the City Commission needs to know the situation up front so the City Commission does not get the impression that the Mechanical Board is trying to cause trouble. Chaney also stated that the board may progress quickly enough that the delay may only be a month.
Wyatt stated that a possibility could be to amend the 2003 UMC to include the omissions just to stay current.
Sparkes questioned if the only difference between the 2003 and 2006 UMC is the ventilation and exhaust provisions?
Wyatt responded that according to staff member Adrian Jones there was no other provisions omitted.
Barrington opined that this is a way for the City to use a loophole to try to get the International Codes adopted that they want so desperately.
Sparkes stated that in the past less than a 5-0 vote would need to be revisited and that is why he had asked the board to strive for a 5-0 vote when recommending a code for adoption. Sparkes also stated that following Johnson County and adopting International codes is not what this board voted on.
Staff responded to Barrington’s comment that when the draft ordinance adopting the International Residential Code was presented to the Building Board, the draft included language deleting all the provisions for mechanical, electrical, and plumbing from the IRC and the Building board voted not to delete the provisions.
Wyatt stated that he wants the City Commission to know that the board is not just blindly recommending the Uniform Mechanical Code, that there are discussions being made. Wyatt also stated he believed that the City (staff) is not trying to push the International but the Home Builders Association members are trying to push for the single book for residential codes.
Chaney asked staff that if the entire residential code is adopted, how staff would approach a field inspection, would it be the International or Uniform.
Staff responded that it was unknown how to proceed in that situation. Staff recommended to the board create and ordinance to remove the mechanical portions and be submitted along with the Residential code ordinance.
Chaney suggested that the board attend the (City Commission) meeting when the Residential code is approved for adoption and present the conflicts it will create by having two codes.
Wyatt suggested conducting a joint meeting with the building board to discuss the conflicts that will arise and avoid working out the conflicts in front of the City Commission.
Chaney agreed to that kind of meeting.
Barrington agreed that a joint meeting approach could work.
Staff stated that a meeting with the boards to resolve conflicts before the City Commission presentation to would be best.
Barrington suggested having a staff member to mediate the meeting.
Estrada stated the issues should be worked out before a presentation to the City Commission.
Chaney made a motion to request a joint meeting as quickly as possible between the Building board and all trade boards (mechanical, electrical, plumbing) to have relevant portions removed from the IRC ordinance and also discuss the option of waiting to adopt the 2006 UMC or amend the mechanical code to include the exhaust and ventilation requirements in the mechanical ordinance. Seconded by Wyatt. Passed 5-0.
Miscellaneous
Chaney requested an item to be placed on a future agenda for discussion. The issue of access doors in ductwork to access fire dampers. In the current code there is no minimum size requirement. The problem arises when the fire dampers must be maintained or a motor must be replaced. He suggested the possibility of an amendment for minimum access size. Barrington stated having the same problem. The board agreed to have the item on a future agenda.
Wyatt inquired about the flat fee proposal by Chaney in previous meeting.
Staff responded that Building inspection is pursing the possibility of a flat fee system.
Motion to adjourn made by Barrington, seconded by Wyatt, passes 5-0. Meeting adjourned at 8:00 p.m.
