RE:	Teller’s Restaurant Sidewalk Dining License

Overland Pizza Company, d/b/a Teller’s Restaurant, 746 Massachusetts, recently applied for a sidewalk dining license.  The related site plan (SP-01-04-05) was approved on the April 19^th Consent Agenda.  The applicant has met all necessary requirements to obtain a sidewalk dining license (including demonstrating that it meets the 70% food sales requirement).  In addition, the applicant requested that its patrons be allowed to possess and consume alcoholic beverages in the outdoor seating area.  As such, enclosed is Ordinance 7876 which, after its effective date, would allow possession and consumption of alcoholic beverages on this portion of city right of way. 

Staff recommends approval of the sidewalk dining license for Overland Pizza Company d/b/a Teller’s Restaurant and adoption of the related Ordinance 7876.
