DRAFT AGREEMENT FOR ANNEXATION
This agreement is entered into between the City of Lawrence, Kansas ("City"), a municipal corporation under the laws of the State of Kansas, and First United Methodist Church of Lawrence, Kansas (FUMC), a non-profit corporation under the laws of the State of Kansas, on this_____ day of , 2004.
In consideration of the mutual promises and covenants contained herein, the City and FUMC hereby agree as follows:
FUMC hereby consents to the annexation into the corporate limits of the City of Lawrence, Kansas the following described real property, to-wit:
A tract of land in the north one half of the northeast quarter of section 31, township 12 south, range 19 east of the sixth principal meridian, in Douglas County, Kansas, described as follows:
Beginning at a point on the west line, 40.00 feet south of the northwest corner of said quarter section, said point being on the south right-of-way line of US Highway 40; thence north 87'34'27" east, along said south right-of-way line, 853.41 feet; thence south 80°13'58" east, along said south right-of-way line, 149.91 feet; thence south 02°25'33" east, 350.00 feet; thence south 71'15'51" east, 739.69 feet; thence on a 750.00 foot radius curve to the right, with a 795.86 foot chord bearing south, 39°13'12" east, an arc distance of 838.92 feet to the south line of the north one half of said quarter section; thence south 87°33'22" west, along said south line, 2170.44 feet to the southwest quarter of said north one half; thence north 02°14'47" west, along the west line of said quarter section, 1286.70 feet to the point of beginning. Contains 46.652
acres, more or less.
Provided that the City shall not make effective the annexation prior to the physical presence of City waterline and sanitary sewer facilities in service of the above described property.
The City acknowledges that FUMC shall construct, or shall begin construction, of an approximately 17,000 square foot building on the above described property prior to City annexation, pursuant to valid approval of Douglas County, and pursuant to all building code and land use regulations of Douglas County; provided that the above described property shall be platted pursuant to the requirements of Douglas County by May 30, 2005, and the above described building shall be constructed according to development standards of the City. Upon annexation, the above described property shall be eligible for City services pursuant to such City policies and laws governing the extension and provision of such services.
This agreement shall be binding upon all successors and assigns of the above described property, or portions thereof. This agreement is a covenant running with the above described property and all owners thereof.
