ORDINANCE NO. 7817
AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS
MAKING CERTAIN DETERMINATIONS AND PROVISIONS CONCERNING
THE APPROPRIATION AND BUDGETING OF PROPERTY TAX REVENUE
FOR THE YEAR 2005 CITY BUDGET PURSUANT TO THE
PROVISIONS OF K.S.A. 79-2925b
Whereas, the governing body of the City of Lawrence, Kansas (City) has determined that for the year 2005 City budget it shall be necessary to appropriate and budget property tax revenues in an amount which exceeds the revenues budgeted and appropriated for the year 2004.
Whereas, the Kansas Legislature has failed to fully fund significant revenue sources for the City pursuant to the statutorily required fund formulas for the Local Ad Valorem Tax Reduction Fund, the City – County Revenue Sharing Fund, and the Special Highway Fund; and that the failure to fully appropriate State funds as established by State law creates additional property tax revenue requirements for the City; and
Whereas, the governing body shall consider this ordinance at the time of the public hearing for the year 2005 City budget on August 10, 2004;
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
SECTION 1: The above recitals are hereby adopted and incorporated by reference as if fully set forth herein.
SECTION 2: Pursuant to the provisions of K.S.A. 79-2925b, the governing body hereby determines and provides that for the year 2005 City budget it shall be necessary to appropriate and budget property tax revenues in an amount that exceeds the revenues budgeted and expended for the budget year 2004. The year 2005 City budget shall provide for property tax revenues in an amount exceeding the year 2004 property tax revenues.
SECTION 3: This ordinance shall be supplemental to the ordinance adopting and appropriating the year 2005 City budget.
SECTION 4: This ordinance shall take effect upon and after its publication in the official City newspaper.
