ORDINANCE NO. 7805

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS PROVIDING FOR REVISED COURT COSTS ASSESSED BY THE MUNICIPAL COURT OF THE CITY OF LAWRENCE BY AMENDING SECTIONS 1-113 AND SECTION 12-105 OF THE MUNICIPAL CODE OF THE CITY OF LAWRENCE.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

Section 1.        Section 1-113 of the Code of the City of Lawrence, 2003 Edition and amendments hereto, is hereby amended to read as follows:

1-113      CODE VIOLATIONS; COURT COSTS.

Whenever any person is convicted of a violation of any provisions of this Code, the offender shall be assessed costs for the administration of their case in Municipal Court.  The costs in each case shall be assessed by the Judge of the Municipal Court, but in no case shall the costs be more than $32.50 or the amount of the fine to be paid, whichever is less.

Section 2.        Section 12-105 of the Code of the City of Lawrence, 2003 Edition and amendments thereto, is hereby amended to read as follows:

12-105    COURT COSTS.

Pursuant to Charter Ordinance No. 17, whenever any person is convicted of a violation of any provisions of this Code, the offender shall be assessed costs for the administration of their case in Municipal Court.  The costs in each case shall be $32.50.  In addition thereto, the Judge of the Municipal Court shall assess all State imposed fees as required by statute.

Section 3.        Section 1-113 and 12-105 of the Code of the City of Lawrence, Kansas, 2003 Edition and amendments thereto are hereby repealed it being the intent of this ordinance to supercede the repealed provisions. This ordinance shall be effective on and after publication as provided by law.
