ORDINANCE NO. 7764
AN ORDINANCE PROVIDING FOR THE REZONING OF APPROXIMATELY 20.1626 ACRES FROM B-3 (LIMITED BUSINESS) DISTRICT TO RM-1 (MULTIPLE-FAMILY RESIDENTIAL) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.
WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on January 30, 2004, recommended that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from B-3 (Limited Business) District to RM-1 (Multiple-Family Residential) District.
WHEREAS, after due and lawful notice the zoning recommendation came on for hearing before the governing body of the City of Lawrence, Douglas County, Kansas on March 1, 2004, and after due consideration and deliberation the recommended zoning change was approved with the conditions of the Planning Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
SECTION I. The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.
SECTION II. That the zoning district classification for the following described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:
A PART OF LOT 1 IN LAKE ESTATES SUBDIVISION NO. 7 AND AN UNPLATTED TRACT OF LAND ALL IN THE SOUTHWEST QUARTER OF SECTION 5, TOWNSHIP 13 SOUTH, RANGE 19 EAST, IN DOUGLAS COUNTY, KANSAS MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHEAST CORNER OF SAID SOUTHWEST QUARTER; THENCE ON A PLAT BEARING OF SOUTH 87º58'15" WEST, ALONG THE SOUTH LINE OF SAID SOUTHWEST QUARTER, A DISTANCE OF 418.14 FEET TO THE POINT OF BEGINNING; THENCE CONTINUE SOUTH 87º58'15" WEST, ALONG THE SOUTH LINE OF SAID SOUTHWEST QUARTER, A DISTANCE OF 553.38 FEET; THENCE NORTH 02º01'45" WEST A DISTANCE OF 249.84 FEET TO THE SOUTH LINE OF SAID LOT 1; THENCE NORTH 02º02'34" WEST A DISTANCE OF 53.22 FEET; THENCE ALONG A CURVE TO THE LEFT A DISTANCE OF 373.39 FEET, SAID CURVE HAS A RADIUS OF 335.00 FEET AND A CHORD WHICH BEARS NORTH 33º58'25" WEST A DISTANCE OF 354.36 FEET; THENCE NORTH 65º54'15" WEST A DISTANCE OF 437.86 FEET; THENCE ALONG A CURVE TO THE RIGHT 382.68 FEET, SAID CURVE HAS A RADIUS OF 335.00 FEET AND A CHORD WHICH BEARS NORTH 33º10'44" WEST A DISTANCE OF 362.23 FEET; THENCE NORTH 00º27'13" WEST A DISTANCE OF 67.13 FEET TO THE NORTH LINE OF SAID LOT 1; THENCE NORTH 87º54'05" EAST, ALONG THE NORTH LINE OF SAID LOT 1, A DISTANCE OF 649.49 FEET; THENCE NORTH 87º57'29" EAST, ALONG THE NORTH LINE OF SAID LOT 1, A DISTANCE OF 392.20 FEET TO THE NORTHEAST CORNER OF SAID LOT 1; THENCE CONTINUE NORTH 87º57'29" EAST A DISTANCE OF 27.78 FEET; THENCE SOUTH 07º44'08" EAST A DISTANCE OF 154.95 FEET TO A POINT ON THE EAST LINE OF SAID LOT 1; THENCE SOUTH 17º40'36" EAST, ALONG THE EAST LINE OF SAID LOT 1, A DISTANCE OF 870.00 FEET TO THE SOUTHEAST CORNER THEREOF; THENCE SOUTH 02º01'45" EAST A DISTANCE OF 181.26 FEET TO THE POINT OF BEGINNING. CONTAINING 878,285 SQUARE FEET OR 20.1626 ACRES, MORE OR LESS.
be and the same is hereby changed from B-3 (Limited Business) District to that of RM-1 (Multiple-Family Residential) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto.
SECTION III. That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.
SECTION IV. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
