                                                ORDINANCE NO. 7772

 

AN ORDINANCE PROVIDING FOR THE REZONING OF APPROXIMATELY 12.3 ACRES FROM PCD-2 (PLANNED COMMERCIAL DEVELOPMENT) DISTRICT TO M-1 (RESEARCH INDUSTRIAL) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.

 

WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on February 25, 2004, recommended that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from PCD-2 (Planned Commercial Development) District to M-1 (Research Industrial) District.

 

WHEREAS, after due and lawful notice the zoning recommendation came on for hearing before the governing body of the City of Lawrence, Douglas County, Kansas on March 16, 2004, and after due consideration and deliberation the recommended zoning change was approved.

 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION I.  The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.

 

SECTION II.  That the zoning district classification for the following described tracts of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:

 

TRACTS OF LAND IN THE SOUTHWEST QUARTER OF SECTION 33, TOWNSHIP 12 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN, IN DOUGLAS COUNTY, KANSAS, DESCRIBED AS FOLLOWS:

 

BEGINNING AT THE NORTHEAST CORNER OF LOT 1, BLOCK TWO, OREAD WEST NO 10, A SUBDIVISION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS; THENCE SOUTH 61º47’48” WEST, ALONG THE NORTH LINE OF SAID LOT 1, 300.00 FEET TO THE NORTHWEST CORNER OF SAID LOT 1; THENCE NORTH 28º12’11” WEST, 35.36 FEET TO THE CENTERLINE OF LEGENDS DRIVE; THENCE NORTH 37º30’41” WEST, 865.74 FEET TO A BOUNDARY POINT ON THE EAST LINE OF FOX CHASE EAST ADDITION, A SUBDIVISION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS; THENCE NORTH 88º19’34” EAST, 491.82 FEET; THENCE SOUTH 28º12’11” EAST, 670.03 FEET TO THE POINT OF BEGINNING. THE ABOVE CONTAINS 6.391 ACRES, MORE OR LESS.

 

BEGINNING AT THE SOUTHERNMOST CORNER OF LOT 27, BLOCK ONE, FOX CHASE EAST ADDITION, A SUBDIVISION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS; THENCE NORTH 12º38’57” EAST, ALONG THE EAST LINE OF SAID FOX CHASE EAST ADDITION, 489.77 FEET; THENCE SOUTH 37º30’41” EAST, 865.74 FEET TO THE CENTERLINE OF LEGENDS DRIVE; THENCE SOUTH 61º47’48” WEST, ALONG SAID CENTERLINE, 316.75 FEET TO THE CENTERLINE OF THE NATURAL GAS LINE EASEMENT AS SHOWN ON THE FINAL PLAT OF SAID FOX CHASE EAST ADDITION; THENCE NORTH 48º29’06” WEST, ALONG SAID CENTERLINE, 485.48 FEET TO THE SOUTHERN EXTENSION OF THE EAST LINE OF SAID LOT 27; THENCE NORTH 12º38’57” EAST, ALONG SAID SOUTHERN EXTENSION, 37.68 FEET TO THE POINT OF BEGINNING. THE ABOVE CONTAINS 5.680 ACRES, MORE OR LESS.

 

BEGINNING AT THE NORTHWEST CORNER OF LOT 1, BLOCK TWO, OREAD WEST NO. 10, A SUBDIVISION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS; THENCE SOUTH 61º47’48” WEST, ALONG A LINE PARALLEL WITH AND 4.64 FEET NORTH OF THE SOUTH RIGHT-OF-WAY LINE OF LEGENDS DRIVE, 303.69 FEET TO THE CENTERLINE OF THE NATURAL GAS LINE EASEMENT AS SHOWN ON THE FINAL PLAT OF FOX CHASE EAST ADDITION, A SUBDIVISION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS; THENCE NORTH 48º29’06” WEST, ALONG SAID CENTERLINE, 37.70 FEET TO THE CENTERLINE OF LEGENDS DRIVE; THENCE NORTH 61º47’48” EAST, ALONG SAID CENTERLINE OF LEGENDS DRIVE, 316.75 FEET; THENCE SOUTH 28º12’11” EAST, 35.36 FEET TO THE POINT OF BEGINNING. THE ABOVE CONTAINS 0.252 ACRE, MORE OR LESS.

 

be and the same is hereby changed from that of PCD-2 (Planned Commercial Development) District to M-1 (Research Industrial) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto.

 

SECTION III.  That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.

 

SECTION IV.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
