In 1998, the City of Lawrence completed one of the first priority one projects recommended by the 1996 Stormwater Management Master Plan near the area of 3rd Street and Michigan.  Various drainage easements were acquired for the concrete stormwater channel that was constructed.  In 1997, The City of Lawrence also purchased an entire tract and home at 240 Michigan (Lot 72, Block 9 West Lawrence).  The home was removed as part of the project as a large drainage easement was needed on this parcel.  The City of Lawrence is currently the property owner for this lot.

 

As part of the negotiations to obtain a 20 foot drainage easement over the adjacent lot to the north, located at 242 Michigan, City legal and public works staff obtained the donation of the drainage easement on Lot 70.  This donation was in exchange for a future transfer of the unneeded remaining portion of Lot 72 owned by the City to the property owners.  Steven and Virginia Wingert are the current property owners of 242 Michigan.  The Wingerts and the City of Lawrence shared equally in the costs of preparing the appropriate survey work completed by EBH & Associates which would be required to replat Lot 70 and Lot 72 (see attached Reeder Subdivision Plat).  This plat has been approved and executed by the Mayor.  In order to finalize recording of the plat, the Douglas County Register of Deeds has requested that the City formally transfer its ownership of a portion of Lot 72 as noted on the plat, to the Wingerts.  The attached Quit Claim Deed will satisfy this request and allow for the filing of the plat.  The City will retain ownership of Tract A of the plat as a drainage easement.

 

City legal staff requests authorization of the Mayor to execute the Quit Claim Deed on behalf of the City, transferring ownership to Steven and Virginia Wingert.
