ITEM NO. 4:                      FINAL PLAT FOR ALDI SUBDIVISION; A REPLAT OF LOT 9,                                                           LAWRENCE AUTO PLAZA; 3025 IOWA STREET (JLT)

         

PF-12-24-03:  Final Plat for ALDI Subdivision, a replat of Lot 9, Lawrence Auto Plaza.  This proposed two-lot commercial subdivision contains 3.061 acres and is located north of 31st Street and west of Iowa Street.  Submitted by BG Consultants, Inc., for ALDI, Inc., property owner of record.

4.         No access to Lot 1 or Lot 2. The only access to 31st Street will be at the access easement (the west 75’ of Lot 2). (Noted)

 

                

5.         Final plat needs to show ALL utility easements associated with Lots 1 and 2. Show all easements on Lots 1 and 2 and on all adjacent lots to Lots 1 and 2. (Revised)

REASON FOR REQUEST

 

The request is for the final plat approval of a replat of Lot 9, Lawrence Auto Plaza Addition from one single lot to two individual lots. At present, ALDI’s store is located in the northern half of Lot 9, Lawrence Auto Plaza Addition. The replatting of Lot 9 will result in two individual lots; the southern lot (Lot 2) is proposed to be developed by Peoples Bank. ALDI’s will remain on the northern lot (Lot 1).  The 3.061 acre single lot will be split between Lot 1 (2.253 acres) and Lot 2 (0.808 acres). Both lots will remain C-5 (Limited Commercial) District-zoned lots.   

 

 

ACCESS

 

Because no direct access to either lot is provided from Iowa Street, access to both lots is provided off of 31st Street through a shared access easement. With creation of a second lot, an additional cross access easement must be filed with the plat to provide access to Lot 2.  

 

UTILITIES

 

The sanitary sewer main must be extended to touch Lot 2. Public improvement plans for this extension must be submitted to the Public Works Department prior to filing the plat.

 

CONFORMANCE

 

The proposed two commercial lots meet the minimum C-5 (Limited Commercial) District lot size requirements for lot area, lot width and lot depth. The ALDI Subdivision Final Plat complies with the Subdivision Regulations. The lot corners have been pinned.

 

RECOMMENDATION:        

 

Staff recommends approval of the Final Plat of the ALDI Subdivision and forwarding it to the City Commission for acceptance of easements, subject to the following conditions:

 

1.      Provision of the following fees and recording documentation:

    1. Current copy of paid property tax receipt at the time of submittal of the final plat for filing;
    2. Recording fees made payable to the Douglas County Register of Deeds.
    3. Submittal and approval of a Master Street Tree Plan.
  1. Execution of a Temporary Utility Agreement.
  2. Submittal of public improvement plans (for sanitary sewer plans) to the City Public Works Department prior to filing of the final plat.
  3. Filing of a cross access easement providing access to Lot 2.
  4. Provision of a note on the face of the plat that provides a Book and Page reference to filed cross access easement between Lots 1 and 2.
  5. Revise name of Planning Commission Chair on face of plat.
